Only certain categories of people may qualify
In England and Wales, various categories determine whether you qualify to make a claim. In order to make a claim, you need to have a relationship with the deceased, such as by being:
- Their wife or husband
- A person who was living with them as a defacto spouse.
- Their same-sex partner.
- Their (divorced) former wife or husband, or a former defacto spouse who has not remarried.
- Their child.
- A child who was treated as a child of the deceased in relation to a marriage of the deceased.
- A person who was partly or wholly maintained by the deceased immediately before the deceased's death.
- A person who has acted as a carer.
Please treat this list as a guide, as it can be a complex issue as to whether you qualify to apply:
- Do not assume that you are qualified to make a claim until you ask Johansson Solicitors.
- Similarly, Do not assume that you are not qualified to make a claim until you ask Johansson Solicitors. It sometimes turns out that people are qualified, even though they do not appear to be on the above list.
Time limits
Remember, if you do not commence your claim within 6 months of the date of the Grant of Probate or Letters of Administration, you may lose your rights entirely.
